Grievance Arbitration

Going to court can be expensive and take a long time to reach a decision.  Arbitration, where a private judge called an arbitrator makes a binding decision for the parties, can be a good alternative to litigation in resolving disputes, grievances, and unfair labor practices that arise under a Collective Bargaining Agreement (CBA).

Arbitration:

  • Allows parties to have a subject matter expert rather than a random judge who may have practiced in a different legal field before joining the bench.
  • Is binding with limited grounds for vacating an award.
  • Is generally faster and cheaper than litigation.
  • Is conducted under rules that ensure due process and equal protection are integral to the process.
  • Permits parties to fully present evidence and question witnesses.
  • Allows for parties to be represented by legal counsel.
